Extradition and the UK

Extradition is the process by which a person suspected or convicted of a crime in one country can be sent to that country from a second country. Whether or not the extradition of an individual is possible largely depends on:

  • whether an extradition treaty or convention exists between the two countries; and,
  • the seriousness of the crime.

To be eligible for extradition an individual must generally be suspected or convicted of a crime which could result in a 12-month prison sentence in either of the countries involved.

Benefits of Immigration

In response to a recent House of Lords Committee report on the economic impact of migration into the UK, the British government "overwhelmingly agreed" with the Committee's recommendations that economic benefits should influence immigration policy.

Evidence was presented by the government showing that immigration has made a positive contribution to GDP per capita of people born in the UK by creating a more robust labour market. Between 1997 and 2007, the United Kingdom lead the G7 nations (Canada, France, Germany, Italy, Japan, UK, USA) in annual GDP growth rate.

Asylum Seekers and Permission to Work in the UK

Asylum seekers are generally not permitted to work in the UK whilst their claim for asylum is processed. UK asylum seekers may be entitled to receive financial support and be homed while their application is being considered. This entitlement usually applies to those asylum seekers who have no means of supporting themselves financially and would otherwise be rendered destitute if not given financial assistance by the state. Asylum seekers may also receive free medical treatment from the NHS whilst awaiting the outcome of their application.

Arriving in the UK

Anyone arriving in the UK from another country - whether they are on holiday or coming to the UK as an immigrant - should ensure that they are prepared. Careful preparation will help to minimise delays on entering the UK and reduce the risk of being refused entry.

Before Travelling to the UK

Depending on the purpose and length of their visit people travelling to the UK should make sure that they have the following items easily accessible in their hand luggage for when they arrive:

  • Passport or other travel document together with any visa and /or entry clearance that is required under the immigration rules;
  • Any documents which may have to be produced under the terms of a visa to confirm the purpose of the visit to the UK;
  • Documents which prove that the visitor or immigrant can support themselves financially during the course of their stay in the UK.

Arriving in the UK

All travellers arriving in the UK must go through passport control upon their arrival in the country. All passports will be checked – including those issued by the UK, the European Union (EU), the European Economic Area (EEA) and Switzerland. Passports are scanned electronically to ensure that they are genuine.

Find the Right Immigration Barrister

What are the advantages of instructing an immigration barrister over that of a solicitor?

The short answer is it is likely to save you money. Previously clients were not allowed to engage the services of an immigration barrister without first instructing a solicitor. If your case needed an immigration barrister you would have to engage an immigration solicitor or immigration lawyer thereby paying for two lawyers rather than just one. The Public Access scheme now permits you to go direct to an immigration barrister.

Who can instruct an immigration barrister?

Anyone can instruct an immigration barrister under the public access scheme. Note however that the ‘cab rank’ rule does not apply to public access work and a barrister is not therefore obliged to accept the instruction. On this site we will accept instructions from clients from all spheres including company/commercial clients, government and non-governmental organisations for matters relating to immigration.
